Terms and Conditions

The following terms and conditions apply to all orders placed by the customer (referred as “you”) with the company DESMARK CORPORATION (referred as “Desmark”) at the desmark website, mobile website or mobile application (referred to as desmark.com.ph)

Please make sure you are over eighteen (18) years of age before placing an order on desmark.com.ph. The products offered are limited to certain areas of the Philippines wherein a desmark branch is located. (refer to location map). Beyond that will be for viewing purposes only.

By placing an order in desmark.com.ph, you agree to be bound by the Terms and Conditions set out herein. Please read and understand said Terms and Conditions before placing your order.

Please note that desmark reserves the right to amend the terms without prior notice to you. The version of the Terms that will apply to your order will be those on desmark.com.ph at the time you place your order.

  1. Prices and Delivery Charges
    • The prices indicated in the website does not include delivery charges. We try our best to make sure all prices are correct and accurate. In an event of any wrong pricing, we will contact you immediately and give you the option to cancel and get a full refund.
    • Delivery Charges vary depending on method and location. Please note that delivery schedules may vary and subject to any delays resulting from third party shippers or force majeure which we will not be responsible.
  2. Placing an Order 
    • Select the items you want to purchase and add them to your shopping basket by clicking on the corresponding icon.
    • To proceed with the purchase, the user’s personal details will be required and will be included in our database in order to process the order. These personal details will be in accordance to our Privacy Policy. Please be reminded that inaccurate information will lead to errors or cancellation of the purchase.
    • In order to contract with desmark.com.ph, you must be over 18 years of age and must possess a valid credit card or debit card issued by a bank acceptable to us.  Desmark reserves the right to refuse any request made by you. Where a contract is made with a third party payment service provider or transport service provider, the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.Payments other than the one specified in the confirmation page will not be accepted.
  3. Completing the Order
    • Once the order has been completed, and before the order is confirmed, the user will be provided with an itemized summary of the order including delivery charges and other possible charges such as taxes. Customer must click on CONFIRM to complete the purchase transaction.
    • You will then receive an email summarizing your transaction. If, for any reason, we are unable to fulfill the order in accordance with the email confirmation, we will let you know as soon as possible. You will then be given the option to cancel and be given a full refund.
  4. Delivery of Order
    • Desmark will endeavor to deliver your unit based on the stated delivery address. We aim to deliver as soon as possible within 30 days. Should it exceed, we will contact you with the option to cancel and get a full refund.
  5. Cancellation of Order
    • The cancellation of order is only possible if unit has not left the store premises.  Should you wish to cancel, please call our hotline immediately. Failure to do so will no longer allow you to cancel and charges will apply.
  6. Returning an Order
    • Returning and exchanging of items is permissible only if the product shipped is not the product you ordered or is faulty, damaged or defective. If return or exchange is due to your negligence, your improper handling, “change of mind” or “wrong unit was clicked”, then return or exchange of unit is not possible.
    • If unit is defective or wrongly delivered, please notify us not more than 5 business days from receiving the unit. This does not mean automatic replacement or refund as proper investigation will be done via the authorized service center of unit purchased. A return or exchange can only be possible if the authorized service center confirms a factory faulty unit and a replacement needs to be given. There are also some instances wherein the service center will confirm that the problem is a minor issue and will just replace the defective parts of the unit. Desmark will deliver your new item or repaired item as soon as possible.
    • To return an order, please contact us for your options. Please note that we are not obligated to refund but we will replace your unit if approved by the authorized service center. Please also note that the item must be in its original delivery condition, and you will bear the shipping charges and with original copy of Sales Invoice. We may also charge processing fees and handling fees depending on the circumstances of the return.
  7. Indemnity
    • The website does not cater to installment terms.  Full payment via credit card or debit card is required.
  8. Ownership of rights:
    • Any use of desmark.com.ph or its contents other than for your own personal, non-commercial use, is prohibited without permission.
  9. Payment Methods
    • You agree to indemnify, defend and hold harmless desmark.com.ph, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.
